Terms of Service

These Terms of Service ("Terms") govern your use of the HOPE Health telehealth platform and related services provided by HOPE Health Inc. ("HOPE Health," "we," "us," or "our"). By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, do not use our platform.
1. Eligibility
To use HOPE Health services, you must:
- Be at least 18 years of age.
- Be a resident of Canada and physically located in a province where our physicians are licensed to practise.
- Provide accurate and truthful information during registration and medical assessments.
- Have the legal capacity to enter into a binding agreement.
We reserve the right to refuse or discontinue service to anyone who does not meet these requirements.
2. Not an Emergency Service
Important Safety Notice
HOPE Health is not an emergency medical service. If you are experiencing a medical emergency, chest pain, difficulty breathing, suicidal thoughts, or any condition requiring immediate attention, please call 911 or go to your nearest emergency department immediately.
Our platform is designed for non-urgent telehealth consultations related to weight management. Response times may vary and are not suitable for time-sensitive medical concerns.
3. Medical Disclaimer
By using our services, you acknowledge and agree that:
- HOPE Health facilitates access to licensed Canadian physicians who provide telehealth consultations. We are not a healthcare provider.
- Telehealth services are not a replacement for in-person medical care. You should continue seeing your primary care physician for comprehensive health management.
- Treatment outcomes vary from person to person. We do not guarantee specific results from any medication or treatment plan.
- Prescribing decisions are made solely by the treating physician based on their independent medical judgment. Not all patients will qualify for medication.
- You are responsible for disclosing all relevant medical history, current medications, and health conditions to your treating physician.
- GLP-1 receptor agonist medications carry potential side effects and risks. Your physician will discuss these with you before prescribing.
4. Your Account
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately at privacy@hopetelehealth.ca if you suspect unauthorized access to your account.
- Ensuring that all information you provide is accurate, complete, and up to date.
You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Fees & Payment
- Consultation fees and any applicable charges will be clearly displayed before you confirm a purchase or service.
- Medication costs are separate from consultation fees and are set by the dispensing pharmacy.
- All fees are in Canadian dollars (CAD) and are subject to applicable taxes.
- Refund policies, if any, will be communicated at the point of purchase.
6. Acceptable Use
When using our platform, you agree not to:
- Provide false or misleading medical information.
- Attempt to obtain medications for someone else using your account.
- Use the platform for any unlawful purpose.
- Interfere with the security or functionality of the platform.
- Harass, abuse, or threaten HOPE Health staff or physicians.
- Reproduce, distribute, or reverse-engineer any part of our platform.
7. Intellectual Property
All content, design, trademarks, and technology on the HOPE Health platform are owned by or licensed to HOPE Health Inc. and are protected by Canadian and international intellectual property laws. You may not copy, modify, or distribute any part of our platform without our prior written consent.
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- HOPE Health provides its platform on an "as is" and "as available" basis.
- We make no warranties, express or implied, regarding the platform's availability, accuracy, or fitness for a particular purpose.
- HOPE Health shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform.
- Our total aggregate liability to you for any claim arising from these Terms or your use of the platform shall not exceed the total fees you paid to HOPE Health in the 12 months preceding the claim.
- Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
9. Termination
You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, provide false information, or engage in conduct that we determine is harmful to other users or the platform. Upon termination, your right to use the platform ceases, but provisions regarding health record retention, limitation of liability, and governing law will survive.
10. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall be resolved in the courts of the Province of Ontario, and you consent to the exclusive jurisdiction of those courts.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our platform. Your continued use of the platform after changes take effect constitutes your acceptance of the revised Terms.
